Terms and Conditions for Any-Ship (Streamlined Send, LLC)

These Terms and Conditions ("Terms") govern your access to and use of the website and services (collectively, the "Service") operated by Streamlined Send, LLC d/b/a Any-Ship ("Company," "Any-Ship," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. ACCEPTANCE AND BINDING AGREEMENT

   By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and the Company. If you do not agree to any provision of these Terms, you must immediately cease using the Service.

2. USER ELIGIBILITY AND RESPONSIBILITIES
   • Age Requirement: The Service is intended solely for users who are eighteen (18) years of age or older. By using the Service, you represent and warrant that you meet this age requirement.
   • Information Accuracy: You are solely and exclusively responsible for ensuring the accuracy, completeness, and legality of all information you provide, including sender and recipient information, package contents, customs declarations, and payment information.
   • Address Validation: While we may provide address validation tools, you remain solely responsible for verifying all addresses. We are not liable for delivery failures, delays, or additional charges resulting from incorrect addresses you provide.
   • Prohibited Content: You agree not to ship any illegal, hazardous, prohibited, or restricted items as defined by applicable law or carrier restrictions. You assume full liability for any consequences of shipping prohibited items.
3. ACCOUNT SUSPENSION, RESTRICTION & VERIFICATION
   • Right to Suspend or Restrict: We may, at our sole discretion and without prior notice, suspend, restrict, or limit your access to all or part of the Service — including temporarily disabling your ability to purchase shipping labels — if we suspect fraud, abuse, unauthorized or high-risk activity, payment or chargeback problems, or any violation of these Terms or applicable law.
   • Identity & Account Verification: We may require identity, business, or payment verification as a condition of opening, continuing, or restoring access to your account. You agree to provide reasonably requested verification information promptly.
   • Effect of a Hold: While your account is on hold or restricted, you may continue to access your login and order history, but you may be unable to purchase new labels until the matter is resolved. Any uncaptured payment authorization tied to an incomplete purchase may be voided, and no shipping label is created during a hold.
   • No Liability; Reasons May Be Withheld: We are not liable for any loss arising from a suspension, restriction, or termination of access, and we are under no obligation to disclose the specific reasons for such action. Reinstatement is at our sole discretion following resolution or successful verification.
   • Termination: We may suspend or terminate your account and refuse service to anyone for any lawful reason, including repeated or serious violations of these Terms.
4. SERVICE NATURE AND THIRD-PARTY CARRIERS
   • Platform Service Only: Any-Ship is solely a technology platform that facilitates shipping label creation and rate comparison. WE ARE NOT A SHIPPING CARRIER. All actual shipping services are performed by independent third-party carriers (USPS, UPS, FedEx, DHL, etc.).
   • No Control Over Shipping: We have no control over, and assume no responsibility for, the actual pickup, transportation, handling, or delivery of your packages. All shipping performance is subject to the terms and conditions of the respective carriers.
   • Rate Information: Shipping rates and delivery estimates are provided by third-party carriers and are subject to change without notice. We make no guarantees regarding rate accuracy or delivery performance.
5. COMPLETE DISCLAIMER OF LIABILITY FOR SHIPPING ISSUES

   IMPORTANT: NO LIABILITY FOR SHIPPING PROBLEMS

   • We are NOT responsible for lost, stolen, damaged, or delayed packages
   • We are NOT responsible for delivery failures or incorrect deliveries
   • We are NOT responsible for customs delays, duties, or seizures
   • We are NOT responsible for carrier service disruptions or limitations
   • We are NOT responsible for package contents or their condition
   • All shipping-related issues must be resolved directly with the carrier
6. PAYMENT AND BILLING
   • Payment Processing: All payments are processed through third-party providers (Stripe, PayPal). We do not store payment card information and are not liable for payment processing issues.
   • No Refunds: All sales are final. We do not provide refunds for shipping labels once created. Any refund requests must be made directly to the carrier according to their policies.
   • Price Changes: We reserve the right to change our fees at any time without prior notice.
7. COMPREHENSIVE DISCLAIMER OF WARRANTIES

   THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"

   WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED SERVICE. We make no warranty that the Service will meet your requirements or be error-free.

8. LIMITATION OF LIABILITY

   MAXIMUM LIABILITY LIMITATION

   IN NO EVENT SHALL ANY-SHIP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including but not limited to:

   • Loss of profits, data, or business opportunities
   • Cost of substitute services or goods
   • Business interruption or loss of use
   • Personal injury or property damage
   • Any damages related to shipping performance

   OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE LESSER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING YOUR CLAIM.

9. INDEMNIFICATION

   YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS ANY-SHIP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEY'S FEES) arising from or related to:

   • Your use of the Service
   • Your violation of these Terms
   • Your shipping activities or package contents
   • Any third-party claims against us arising from your conduct
   • Any inaccurate information you provide
10. FORCE MAJEURE

    We shall not be liable for any delay or failure in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet outages, or carrier service disruptions.

11. DISPUTE RESOLUTION AND GOVERNING LAW
    • Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
    • Jurisdiction: Any disputes must be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
    • Class Action Waiver: You waive any right to participate in class action lawsuits against us.
12. MODIFICATIONS TO TERMS

    We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will provide notice of material changes, but you are responsible for reviewing Terms periodically.

13. SEVERABILITY

    If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

    These Terms constitute the entire agreement between you and Any-Ship regarding the Service and supersede all prior agreements and understandings.
